TERMS AND CONDITIONS FOR LONG TERM POSITIONS
(OVER 8 WEEKS)
The terms and conditions of business set out below are
between Alphabet Childcare ( South West ) Ltd (The Company) and the prospective employer (The
Client) and are to be accepted by The Client on engagement of an applicant
introduced by The Company.
The Client agrees to notify The Company immediately an
engagement is accepted and to pay the fee of The Company within fourteen
days of invoice. The Agency fee is for the engagement of one employee and
subsequent employees will be charged at the full fee.
In the event of The Client cancelling the agreement of
employment after a firm offer has been made, but before the employee has
taken up the engagement, then a charge of £85 + VAT will be made.
An invoice will be calculated by The Company as set out
in the Scale of Engagement fees below and is payable by The Client on the
acceptance and not the commencement of employment.
Should the relevant employment terminate within eight
weeks, the fee will be refunded to The Client according to the accompanying
scale given, providing that The Client notifies The Company within two
working days of the applicant leaving the employment and that the full fee
has been paid by The Client within fourteen days of the invoice. Should the
Client re-engage the applicant, the full fee will again became payable.
In the event of a temporary employee terminating
employment within the agreed time scale then a percentage of the fee will be
calculated and returned to The Client. However, if The Client terminates the
agreement early, then there will not be a refund returned by The Company for
the unused period.
The Company will calculate the invoice for temporary
contracts on the dates given by The Company at the commencement of
employment. However, should The Client re-engage the applicant for further
periods of employment or extend the original contract dates given to The
Company, then a further charge will be payable for the exact period of
employment up to the maximum sum as set out in the Scale of Engagement fees.
The Company will endeavour to ensure the suitability of
any applicant introduced to The Client but does not accept liability.
Therefore, The Client shall be responsible for satisfying him or her self on
the suitability of any applicant and shall take up any references provided
by the applicant and the Company before engaging the applicant. The Client
shall be responsible for obtaining work and other permits, for the
arrangements of insurance, medical examinations and/or investigations into
the medical history of any applicant and satisfy any medical and other
requirements or qualifications required by law.
All information and introductions are confidential and
must not be passed either directly or indirectly to other potential Clients
or Applicants. The full fee will be payable by the Client to whom the
details were given by The Company if this condition is breached.
An introduction fee will be charged in relation to any
applicant engaged as a consequence of or resulting from an introduction by
or through The Company even though the introduction may be made indirectly.
Clients should reimburse all long distance travelling
expenses incurred by potential employees who present themselves for
interview for residential positions.
The Company does not accept responsibility for any loss
or damage resulting from an introduction by The Company or their provision
of services, acts, omissions or conduct of such introductions.
With full time and part time staff and temporary staff
employed for short term periods, The Company acts as an introducing agent
and does not directly or indirectly employ staff.
The Client will be responsible for the deduction and
payment of Income Tax and National Insurance and provide the employee with a
contract of employment within thirteen weeks of the commencement of
employment as required by law.

2010 PAY RATES FOR LONG TERM EMPLOYEES
Employees should be paid according to their age,
qualifications and/or experience. For Nannies employed in the West Country,
we suggest that the Employee is paid in the region of £7.50 to £9.00 an hour
(gross). This is on appointment and all salaries should be reviewed either
on a six month or annual basis. For those Nannies entering a Nanny Share
Arrangement (i.e. looking after children from more than one set of parents
at any one time), it is suggested that they earn in the region of £8.50 -
£12.00 (gross) an hour which is divided between both Employers. Pay is
normally reduced by about £25.00 a week for live in Nannies.
There is not much difference between a Nanny's salary and
a Nanny / Mother's Help wage, although Mother's Helps tend to be at the
lower end of the scale. These employees are usually untrained and will
assist the mother in caring for the child/ren. As they are not specialists
in child care, Nanny/Mother’s Helps will often help with other domestic
duties not associated with child/ren.
Childminders are self employed and set their own hourly
rate, the average being £4.50 per hour. Childminders differ from Nannies in
as much as they generally charge per child, per hour, whether or not the
children are from the same family.
AGENCY FEES
There is no registration fee for Alphabet Clients. A
charge is payable on the acceptance of an applicant and the introduction fee
must be paid within fourteen days of invoice to qualify for any refunds.
The Agency fee will be
charged according to the following scale:-

If a Nanny is employed after school during term time and
full time hours during the holidays then an average amount of hours over a
year will be used as a calculation.
All Agency fees are subject to VAT, charged at the
current rate.
REFUNDS
A refund of the engagement fee will be made to the
employer on the following basis, provided that the fee has been paid within
14 days.
· An
employee who fails to take up his/her duties and no suitable replacement is
found A FULL REFUND WILL BE MADE excluding a £85+VAT administration charge.
· A
client cancels the agreement of employment after a firm offer has been made,
but before the Nanny takes up a permanent position, an administration fee of
£85+VAT will be charged.
· The
employment is terminated within the four week probationary period by the
employer or employee- 80% of the original fee will be refunded excluding an
administration fee of £85+VAT. Alternatively, a replacement employee will be
found for 25% of the original fee.
· A
permanent applicant leaves the employment within eight weeks of the agreed
commencing date - 50% of the original fee will be refunded excluding an
administration fee of £85+VAT. Alternatively, a replacement employee will be
found for 50% of the original fee.
TERMS AND CONDITIONS – SHORT TERM ASSIGNMENTS

but before the employee has taken up the engagement, the Agency fee will
still be payable in full to offset the costs of organising the cover.
An invoice will be calculated by The Company as set out
in the Scale of Engagement fees below and is payable by The Client on the
acceptance and not the commencement of employment.
In the event of a temporary employee terminating
employment within the agreed time scale then a percentage of the fee will be
calculated and returned to The Client. However, if The Client terminates the
agreement early, then there will not be a refund returned by The Company for
the unused period.

2010 PAY RATES FOR TEMPORARY EMPLOYEES
Employees should be paid according to their age,
qualifications and/or experience. For Nannies employed in the West Country,

(gross - negotiable). Pay is normally reduced by about £25.00 a
week for live in Nannies unless the Nanny has 24 hour sole responsibility
for the child/ren. In this instance, pay should be negotiated with the Nanny
for the complete contract.

AGENCY FEES
There is no registration fee for Alphabet Clients. Agency
fees are calculated on the number of days the Nanny or Nannies provided by
Alphabet Childcare are employed by the family each week. The short term
charges cover a maximum eight week period i.e. 8 weeks @ £50 per week for a
Nanny working 5 days every week - total cost for 8 weeks = £400 + VAT,
should the Nanny or Nannies be required to work after this term, then the
fees are repeatedly calculated for the duration of service required unless a
permanent introduction fee is paid.
Alphabet Childcare will calculate the invoice for short
term contracts on the dates given to the Agency by either the Client or the
Nanny assigned to the contract. If the Client should re-engage the Nanny for
further periods of employment or extent the original contract dates given to
Alphabet Childcare, even if the offer has not been made directly through the
Agency, further charges will apply and invoiced accordingly.
